1. About ToolWorkTap

ToolWorkTap ("the App," "we," "us") is a neighborhood marketplace that connects people who want to rent tools, hire local help, or offer services. We are a listing platform only. We do notown, inspect, repair, deliver, supervise, or guarantee any tool, service, job, or person listed on the App.

2. You Use the App at Your Own Risk

All transactions, communications, rentals, jobs, repairs, pickups, drop-offs, and in-person meetings arranged through ToolWorkTap are entirely between the users involved. You are responsible for your own safety, your own property, your own decisions, and your own compliance with local laws (including any licensing, permit, tax, or insurance requirements that apply to you).

3. Release of Liability

By creating an account or using the App, you agree to release, indemnify, and hold harmless ToolWorkTap, its owners, operators, founders, employees, contractors, affiliates, and anyone associated with the App (collectively, the "Released Parties") from any and all claims, demands, damages, losses, injuries, costs, or liabilities — known or unknown, foreseen or unforeseen — arising out of or related to:

Your use of, or inability to use, the App;
Any tool you rent, lend, borrow, use, or transport;
Any service, repair, or job arranged through the App;
Any in-person meeting, pickup, delivery, or interaction with another user;
Personal injury, property damage, theft, loss, or death;
The conduct, statements, listings, qualifications, or licensing of any other user;
Disputes between users, including payment, quality, or condition disputes;
Content posted by users, including reviews, photos, and messages.

This release applies whether the claim is based on negligence, contract, warranty, strict liability, or any other legal theory, and applies to the maximum extent allowed by law.

4. No Background Checks or Vetting

We do not perform background checks, credential checks, license verification, insurance verification, or skill verification on any user. Badges such as "Licensed" or "Insured" are self-declared by users and are not verified by us. You are responsible for confirming credentials, references, and condition of tools or work before engaging with any user.

5. User Conduct

You agree not to use the App to harass, defraud, threaten, or harm anyone; to post false, misleading, or illegal content; to list stolen, unsafe, or prohibited items; or to circumvent safety features. We may remove content or suspend accounts at our sole discretion.

6. No Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

7. Limitation of Damages

To the fullest extent permitted by law, the Released Parties shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of the App. Our total aggregate liability to you for any claim shall not exceed one hundred US dollars ($100).

8. Disputes Between Users

We are not a party to any rental, job, or service agreement between users. If you have a dispute with another user, you agree to resolve it directly with them and release the Released Parties from any claim related to that dispute.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted means you accept the updated Terms.

10. Acknowledgment

By creating an account, signing in, or using ToolWorkTap, you acknowledge that you have read, understood, and agreed to these Terms of Use, including the release of liability in Section 3.
